An Erie man is in Westmoreland County Prison, accused of asking to have sex with a woman and her daughter, who is now 9 years old.

Timothy James Colcombe, 36, is accused of sending multiple messages to the girl’s mother’s cellphone between August 2021 and November 2022 that included sexual comments referencing the girl, according to a criminal complaint filed by Latrobe police.

In some of the more than 8,000 messages Colcombe sent to the mother, he expressed interest in having sex with both the mother and daughter, police said. On one occasion, he asked for topless pictures of the pair.

According to the complaint, the mother “told Colcombe multiple times through the messages that her daughter was 7-9 years of age.”

In an interview with state police, Colcombe acknowledged that he sent messages to the mother and said it was “late at night while he was consuming alcohol” and that he “was only role-playing,” according to the complaint.

Colcombe’s private defense counsel, Pittsburgh attorney Chris Rand Eyster, declined to comment Friday on the charges against his client.

Colcombe was placed in Westmoreland County Prison after failing to post $25,000 bail.

He is charged with several sexual solicitation counts.

The case initially was reported by the girl’s father to Derry police this past August. According to court documents, the girl complained that an old cellphone her mother had given her to play games on had “photos that she didn’t like,” including a nude photo of her mother and a man.

The girl’s father said he found the phone contained messages of a sexual nature between the mother and “Tim,” police said.

Latrobe police obtained a search warrant for the phone and submitted it to the Westmoreland County District Attorney’s Office for a forensic examination and data extraction. Police also traced the phone number to Colcombe.

According to online court records, Colcombe pleaded guilty to soliciting unlawful contact with a minor and was sentenced to 18 months to three years in prison in 2011 in Armstrong County.

The girl’s mother also is charged with endangering the welfare of children, corruption of minors and harassment and is free on unsecured bond.

She and Colcombe face preliminary hearings Monday before District Judge Tamara Mahady in Unity.
