A Braddock man accused of killing an Armstrong County man during a June robbery in Arnold waived his right to a preliminary hearing in district court on Monday.

The criminal case against Allen Duwayne Herring, 32, now proceeds to Westmoreland County Common Pleas Court. Police said Herring killed Gregory Ray Wynkoop, 35, of East Franklin, during a June 28 robbery.

Herring is the only person facing charges in the case. On Monday, Herring’s defense attorney Brian Aston asked how Herring could be charged with conspiracy when no one else has been charged.

After the hearing, Westmoreland County Detective John Clark said detectives are still investigating the alleged conspiracy.

According to the criminal complaint filed against Herring, Wynkoop had gone to Arnold to buy crack cocaine. Police said Wynkoop gave $70 to a woman so she could arrange for him to get the drugs and she took the money to Herring, her boyfriend.

Wynkoop later picked up Herring and pulled into a gravel lot, the complaint said. Another woman who had been in the car with the men told police she got out of the car after Wynkoop parked and then she heard gunshots.

Herring later told her and his girlfriend that he tried to rob Wynkoop and shot him as they wrestled over Herring’s gun, the complaint said.

Herring remains in Westmoreland County Prison without bond on charges of homicide, robbery, conspiracy and illegal gun possession.
